www.poseidonbike.com and Poseidon Bike Mobile Site, collectively ("Poseidon Bike") collects, uses and is responsible for certain personal information about you. When we do so we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we are responsible as controller of that personal information for the purposes of those laws. Poseidon Bike takes this Privacy Policy and the task of protecting your data very seriously.  We believe that privacy is a fundamental right. This Policy sets out how Poseidon Bike will collect, use, share, and protect your personally identifiable information (“Personal Information).  Personal Information is data that can be used to directly or indirectly identify you. This policy covers our use and treatment of Personal Information that we collect or you provide to us on our web sites, including SMS/Text Alerts and Mobile Web owned by Poseidon Bike, such as http://www.PoseidonBike.com/ (each, a “Website”), and our mobile application (the “Application,” together with Web Site, the “Platform”).  

 

By accessing or using our services, you acknowledge and agree that you consent to the practices and policies outlined in this policy. If you do not agree with this policy, please do not access or use our services or interact with any other aspect of our business. This policy does not apply to the practices of companies that we do not own or control, or to individuals that we do not employ or manage.

We have worked hard to make sure our business complies with the European Union General Data Protection Regulation (GDPR) and California Consumer Privacy Act (CCPA), as well as all other applicable data privacy laws and regulations, and our updates in this version of the policy are part of that work. We will continue to monitor the implementation and interpretation of both GDPR and CCPA, and update this policy as necessary. As such, we ask that even if you do not reside in CA or the European Economic Area that you review changes to this policy each time you use the Platform. 

 

As of the release of this policy, Poseidon Bike does not have any establishments in any EU country and does not currently target any data subjects from EU countries. This Privacy Policy is a separate document from our Terms of Use. 

 

  1. What Information We Collect About You 

 

In order to make your visits to our Platform as worthwhile as possible, we may ask you for Personal Information. We also may collect certain information from your computer each time you visit us that is not Personal Information. For example, non-user specific aggregated data such as information about traffic patterns on the Web Sites.   

 

We collect Personal Information when you provide it to us on our Websites. Such Personal Information may be collected, for example, when you submit a comment or question to us using a “contact us” or similar feature on our Web Sites, send us an email, sign up for an email newsletter or mobile alerts, or in any other way submit information to us via our Web Sites. As applicable, we may also collect and use the information you submit through any support or customer portal related to our Platform. 

 

You may submit information to us for editorial purposes, for example in connection with a review, a story, personal anecdote, quote, or a poll. We may use your name and any stories you provide to us in reviews published online and in our print publications. Editorial content may be attributed to you and we may include your user name and any Personal Information that you provide in an open forum on this Web Site, to facilitate such attribution. 

 

If you receive an email from us, we use certain tools to capture data related to when you open our message, click on any links or banners it contains, and make purchases.  

If you apply for a job posting, or become an employee, we collect information necessary to process your application or to retain you as an employee.  Providing this information is required for employment. 

 

In addition to the information that we collect from you directly, we may also receive information about you from other sources, including third parties, business partners, our affiliates, or publicly available sources.  For example, if you submit a job application, or become an employee, we may conduct a background check.  

 

2.1 Your Devices 

 

We may collect information about your computer, phone, tablet, or other devices you use to access our Platform. Device information may include your connection type, settings, operating system, browser type, IP address, URLs of referring/exit pages, or device identifiers. We may also collect how you use or interact with our Web Sites; any search terms you have entered on our Web Sites or a referral site; and other web usage activity and data logged by our web servers. The amount of this information we collect may depend on the type and settings of the device or browser you use. 

 

The data we collect from your device may be used to administer our services.  We also may store some aggregated metadata from your device. Aggregated metadata is data about data, such as numbers that identify the type of device you have or how many people added comments on one article and the dates those comments were created. Metadata mostly helps us figure out how to make content work on different devices.

We may use “cookies” to keep, and sometimes track, information about you. Cookies are small data files that are sent to your browser when you visit a site that are stored on your device. Cookies improve and personalize your experience on our Web Sites. Poseidon Bike and its affiliates use cookies to gather certain information about users, such as browser type, server, language preference, and country setting, in order to store user preferences on our Sites to make your user experience more consistent and convenient. For example, we may store the recent searches you have performed in a cookie so that we can allow you to easily repeat those searches when you return to our Sites, or so that we can suggest profile information when you sign up for an account and fill out a resume on the Sites (e.g. Indeed Resume).  

 

In addition, we use cookies to maintain your logged in state when you visit our Sites repeatedly. We may also use your IP address to determine your geographic location at city or postal code level in order to provide you with the most relevant search results. 

Provide Measurement Services and Better Targeted Ads, & Marketing 

We use cookies, web beacons, and other similar technologies from third-party partners such as Google for measurement services, better targeting advertisements, and for marketing purposes. This takes place when you visit our Sites and when you download or install an Indeed App. These cookies, web beacons, and other similar technologies allow us to display our promotional material to you on other sites you visit across the Internet.  

 

Our third-party advertising partners may also use these technologies to identify your browsing interests over time and across different websites to deliver targeted advertisements and other content that has been customized for you.  

 

Poseidon Bike may also share information about your behavior on the Sites with third parties (including operators of third-party websites) in order to show you targeted advertisements and other content that has been customized for you. We also use cookies to facilitate the Indeed Targeted Ads Program. In connection with this Program and other advertisements, we use cookies, web beacons and other similar technologies, including from third party partners, to determine which advertisements users have seen, how many times users have seen a particular advertisement, and on which sites a particular advertisement appeared.  

Referral Tracking 

We use cookies, web beacons and other similar technologies, including from third party partners, to associate user activity with the third party website that referred the user to our Sites, or to associate user activity that Indeed referred to a third party website. Some of these third party websites are partner websites that receive credit for the activity of users they refer to our Sites, or give us credit for the activity of users referred to such third party websites.  

Security Purposes 

We use cookies to limit certain types of cyber attacks. 

Testing, Usability, and Performance Improvement Purposes 

We use cookies to ensure users receive a consistent user experience while we conduct A/B testing on certain aspects of our Sites in order to improve our product offerings. We also use cookies to improve the performance and reliability of our Sites. 

Fraud/Spam prevention 

We use cookies during fraud reviews and investigations. Some of our cookie/device tracking happens via 3rd party vendors, other times we use our own indexes to identify activity related to specific cookies. 

Compliance 

We may use cookies to anonymize traffic and activity data we collect about the use of our Sites. 

 

 

2.3 Account Information 

 

If you decide to create an account to Poseidon Bike on any of the Websites, App or Services (a “User Account”), you may submit your full name, e-mail address, home address, phone number, zip code, gender, a profile bio, and birth date. We use this information to facilitate the creation and continued security of your User Account and to assist in facilitating transactions that you initiate through the Websites and Services. We also use it to identify you as a user in our system based on a legitimate interest in providing, personalizing, and improving the Services for an optimal user experience. The information that you contribute or post on the Websites or Services is intended for public consumption, including your reviews, tips, photos, videos, check-ins, comments, likes, posts, events, bookmarks, friends, lists, compliments, and User Account name and profile photo. 

 

2.4 Children 

 

Poseidon Bike does not knowingly collect or solicit any information from anyone under the age of 18 or knowingly allow such persons to register for an account.  If you are under the age of 18, please do not attempt to register for an account or service with us.

How we use the information we collect for business purposes depends in part on which services you use, how you use them, and any preferences you have communicated to us. We may use it for our own research and commercial purposes to make our services smarter, faster, more secure, integrated, and useful to you.  We use collective or aggregated learnings about how people use our services and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement. 

Where required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, we may use information about you in connection with legal claims, regulatory compliance, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business.

Under data protection law, we can only use your personal information if we have a proper reason for doing so, e.g.,

We may share information with our affiliates (such as parent company, subsidiaries, joint ventures, or other companies under common control). If another company acquires our company or our assets, we will also share information with that company.  

 

4.1 Third Parties 

 

We may disclose your Personal Information to a third party for a business purpose.  Before we disclose Personal Information for a business purpose, we enter into a contract with the third party that describes the business purpose for the disclosure. The agreement also requires the third-party recipient to keep the Personal Information confidential and to not use it for any purpose except for fulfilling the business purpose. 

 

Poseidon Bike and it’s affiliates are allowed from selling, leasing, or sharing the data they collect from site visitors and subscribers with third parties. We might share data with service providers to help us with statistical analysis, to send you email, provide customer support, or process payments, but we do not allow any companies we work with to use your Personal Information except to perform the services we request. We vet all entities and only work with those that agree to not use the Personal Information for anything other than the business purpose stated in our agreement with them. They are required by contract to keep your data confidential and secure. To make your user experience better, we may embed code from third parties on the service with your permission.  

 

We have no control over the policies and practices of third-party web sites or businesses. If you choose to take part in any transaction or service relating to a third-party web site or business, please review all policies of such business or web site. 

 

We may disclose information in response to subpoenas, warrants, or court orders, or other legal process, or to comply with relevant laws. We may also share your information to defend against a legal claim or to investigate, prevent, or take action regarding possible illegal activity, suspected fraud, the threatened safety of persons or property, or any violation of our policies. 

 

4.2 Social Networking 

 

The Platform may offer you the ability to share your Personal Information through a social networking site (e.g., Facebook, Twitter, LinkedIn) (“Social Media”). The use of such integrated tools enables you to share Personal Information about yourself with other individuals or the public through Social Media, however such activity is not governed by this Policy. 4.3 Service Providers 

 

We may share your information with service providers. Among other things, service providers may help us to administer our Web Site, conduct surveys, provide technical support, process payments, and assist in the fulfillment of orders.  

 

4.4 Public 

 

Some of our Web Sites may provide the opportunity to post comments or reviews in a public forum.  If you decide to submit such information, that information may be publicly available. 

 

4.5 Links to Other Websites 

 

Our website does contain links to affiliate and other websites. Poseidon Bike does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our website and to read the privacy statements of each and every website that collects personally identifiable information. The aforementioned Privacy Policy Agreement applies only and solely to the information collected by our website. 

 

  1. How Information is Stored 

 

5.1 General Data Security 

 

Poseidon Bike endeavors to protect the privacy of your Personal Information, including using what we believe to be appropriate technical and organizational measures. We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorized way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. 

 

We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so. However, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of your information at any time. We will notify you electronically, in writing, or by telephone of a breach, in accordance with all applicable laws. 

 

5.2 Retention 

 

The length of time we retain certain information depends on the type of information collected. For example, we may retain account/user-type information for as long as your account is active and for a reasonable period thereafter, in case you decide to re-activate. We may also retain some of your information as necessary to comply with our legal obligations, comply with financial rules or laws, to resolve disputes, to enforce our agreements, to support business operations, or to continue to develop and improve our services. Where we retain information for service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our services, not to specifically analyze personal characteristics about you.  

 

If you have elected to receive marketing emails from us, we retain information about your marketing preferences for a reasonable period of time from the date you last expressed interest in our services, such as when you last opened an email from us. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created. 

 

After the applicable retention period, we will either delete or anonymize your information. If deletion or anonymization is not possible, then we will securely store your information and isolate it from any further use until deletion is possible. 

 

5.3 Minor Exceptions to the Above 

 

In some cases, after you unsubscribe from an email newsletter or subscription account, Poseidon Bike may retain your private profile information for a commercially reasonable time for backup, archival, or audit purposes. Please remember that any information that you choose to make public on the Platform may not be removable, such as comments.

Depending on the applicable law, you may have the right to request a copy of your information, to object to our use of your information, to request the deletion or restriction of your information, or to request your information in a structured, electronic format. This section describes your rights and explains how to exercise those rights. We will not discriminate against you for exercising any of your rights.  

 

6.1 Objection and Opt-Out. 

 

Depending on applicable law, you may have the right to “opt-out” or object to certain of our uses of your Personal Information at any point. For example, at the time you are requested to provide Personal Information on this Platform, you may have the opportunity to elect to (or not to) have your Personal Information used in certain ways. You may also make this request by contacting us using the information in the “Contact Us” section or emailing us at info@PoseidonBike.com. In this request, please indicate whether you would like to opt-out of (i) receiving any correspondence from us or from entities affiliated with us or unaffiliated third parties for their marketing purposes; or (ii) opt-out of only specific uses of your Personal Information. You may also opt-out of promotional emails by clicking on an opt-out link within the email you received. In some cases, we may no longer be able to provide you services if you opt-out of certain necessary processing. 

 

6.2 Changing Your Personal Information.  

 

You may request your Personal Information be updated or changed. Some of our Web Sites may allow you to do so directly. Otherwise you can contact us in relation to such requests at info@PoseidonBike.com. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations. 

 

6.3 Deletion.  

 

Poseidon Bike generally keeps your Personal Information for as long as is required for the purpose it is collected, unless a longer retention period is required or permitted by law. You may, however, request that we delete your Personal Information. We may also decide to delete your Personal Information if we believe it is inaccurate, incomplete, or that our continued use or storage of the information is prohibited by our obligations to other parties. When we delete Personal Information, it will be removed from active databases but may remain in archives where it is not practical or possible to delete it. In addition, we may keep your Personal Information as needed to comply with legal obligations, resolve disputes, or enforce agreements.  

 

6.4 Transmission of Personal Information to Other Countries.  

 

Your Personal Information may be processed in the United States, where privacy laws may be less stringent than the laws in your country. By submitting your Personal Information to us you agree to the transfer, storage and processing of your information in the United States. 

 

6.5 Complaints.  

 

We take your privacy seriously; you can contact us with your questions and concerns at info@PoseidonBike.com. You may also have the right to complain to regulatory bodies about our privacy practices. 

 

The General Data Protection Regulation also gives you right to lodge a complaint with a supervisory authority, in particular in the European Union (or European Economic Area) state where you work, normally live, or where any alleged infringement of data protection laws occurred. 

 

  1. Changes to This Policy 

 

We are committed to complying with data privacy laws in every jurisdiction we do business. As such, we may amend this policy from time to time. We will not make changes to this policy without letting you know nor will we make changes that clearly violate our core value that privacy is a fundamental human right. If we do make changes for business or functionality. We may change this privacy notice from time to time, when we do we will inform you. You are bound by any changes to the policy when you use the Platform after such changes have been first posted. If you disagree with any changes to this policy, you will need to stop using the Platform.

  1. Promotional Communications. We may use your personal information to send you updates (by email, text message, telephone or post) about our products AND/OR services, including exclusive offers, promotions or new products AND/OR services. 

We have a legitimate interest in processing your personal information for promotional purposes (see above “How and why we use your personal information”). This means we do not usually need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly. 

We will always treat your personal information with the utmost respect and never sell OR share it with other organizations outside the Poseidon Bike’s group for marketing purposes. 

You have the right to opt out of receiving promotional communications at any time by:

  • Using the “unsubscribe” link in emails or “STOP” number in texts;  

We may ask you to confirm or update your marketing preferences if you instruct us to provide further products AND/OR services in the future, or if there are changes in the law, regulation, or the structure of our business. 

  1. Who We Share Your Personal Information With. We routinely share personal information with: 
  • Our affiliates, including companies within the Poseidon Bike’s group; 
  • Service providers we use to help deliver our products and/or services to you, such as payment service providers, warehouses and delivery companies; 
  • Other third parties we use to help us run our business, such as marketing agencies or website hosts; 
  • Third parties approved by you, including social media sites you choose to link your account to or third-party payment providers; 
  • Credit reporting agencies; 
  • Our insurers and brokers; 
  • Our banks; 

We only allow our service providers to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on service providers relating to ensure they can only use your personal information to provide services to us and to you. We may also share personal information with external auditors. 

We may disclose and exchange information with law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations. 

We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. We will typically anonymize information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations. 

We will not share your personal information with any other third party.

  • Geolocation data; 
  • Audio, electronic, visual, thermal, olfactory, or similar information; 
  • Professional or employment-related information; 
  • Education information, defined as information that is not publicly available personally identifiable information as defined in the Family Educational Rights and Privacy Act (FERPA); and 
  • Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. 

In the preceding 12 months, we have disclosed for a business purpose to one or more third parties the following categories of personal information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household: 

  • Identifiers (e.g., a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers);
